Does every hotel that has Polish Television channels in its rooms have to have a license for rebroadcasting?
Yes, every hotel with Polish Television channels in its hotel rooms must have a licence. This is regulated by the Act on Copyright and Related Rights of 4 February 1994 (with subsequent amendments, in particular Articles 97 and 99) and EU legal regulation in force in this respect, including: Rome Convention of 26 October 1961 for the protection of artists, performers, producers of phonograms and broadcasting organizations.

If I have an agreement with ZAIKS, STOART and other institutions dealing with the protection of copyright and related rights, do I have to sign a license agreement with Polish Television for rebroadcasting of TVP channels in hotel rooms?
Yes, because collective management of copyright organizations such as ZAiKS, ZPAV or STOART only act to protect the copyrights of authors, while rebroadcasting of programs requires the consent of the broadcaster. For entities such as hotels or cable operators, it is therefore necessary to obtain a licence for rebroadcasting of television channels. The licence protects the rights of the broadcasters (in this case TVP) in terms of rebroadcasting.

Does the TV set in the hotel lobby or at the reception desk also count as a hotel rebroadcasting?
No, if a television set is located in a public place, it is not subject to a rebroadcasting licence because in this case it is a public playback for which completely different contracts and rights are needed.
