Monday’s decision staves off the prospect of the Law and Justice (PiS) party losing almost €4 million ahead of next year’s presidential election.
In August, the commission ruled the party had illegally spent 3.6 million złoty (€840,000) on its 2023 electoral campaign, listing electioneering at military recruitment events and an advertisement from the Justice Ministry as examples of misuse of funds.
The decision is the result of a PiS appeal to one of the Supreme Court chambers whose authority the current government does not recognize since it views many of the judges to have been illegally appointed by the previous government.
“We decided to implement the decision of the Supreme Court to adopt the PiS financial report on revenues and expenses in the election held on October 15,” PKW head Sylwester Marciniak told reporters.
Marciniak said the Supreme Court’s verdict was the sole reason for the PKW’s change of position. He added that the ruling must be issued by an institution which is a court within the meaning of the Constitution and the Electoral Code.
“The National Electoral Commission does not determine whether the chamber is a court and does not determine the effectiveness of its ruling,” he was quoted by Reuters as saying.
PiS spokesperson Rafał Bochenek called the earlier suspension of financing illegal and asked for immediate release of the funds.
“Today’s decision of the National Electoral Commission creates an obligation for the finance ministry... to immediately pay out outstanding and withheld funds a total of over 17 million zlotys [€3.98 million],” Bochenek wrote on the X platform.
Marciniak expressed hope that the PKW decision “will reach Finance Minister Andrzej Domański on Tuesday at the latest.”
The regulations oblige the finance minister to implement the decision without delay.
However the prime minister, Donald Tusk, was dismissive of PiS’s chances of regaining their funds.
“’There is no money and there won’t be any’,” he posted on the X platform on Monday. “To my mind that’s what the PKW decision amounts to.”
